WHO IS YOUR DATA CONTROLLER?

Pursuant to Art. 14 para 1 and para 2 of the Regulation (EU) 2016/679 on the protection of personal data hereby we inform that:

Your personal data controller is the Metropolitan Transport Authority (ZTM), with the registered office in Katowice (40-053), 21A Barbary street, email address: kancelaria@metropoliaztm.pl, website: metropoliaztm.pl.

A person for contacts concerning the personal data processing was appointed, email address: iod@metropoliaztm.pl 

WHAT IS THE OBJECTIVE AND LEGAL GROUNDS FOR PERSONAL DATA PROCESSING?

Your personal data will be processed to:

a) pursue from you the payment of a fare and of an additional charge or to consider an appeal,

b) archive the documentation.

The legal grounds for personal data processing consists of:

a) legal obligation of the controller (GPRD Art. 6 para 1(c)) resulting from Art. 33a and Art. 79 of the Transport Law, Art. 121 of the Code of Petty Offences, the Code of Civil Procedure, and the pursuit of a legitimate interest of the controller (GPRD Art. 6 para 1(f), Art. 9 para 2(f)) consisting in determination, pursuit or protection against claims,

b) legal obligation of the controller resulting from Art. 5 of the Act on the National Archive Resource and Archives (GPRD Art. 6 para 1(c), Art. 9 para 2(j)) and the pursuit of a legitimate interest of the controller (GPRD Art. 6 para 1(f)) consisting in protecting the information in case of legal necessity to prove the facts. 

WHAT DATA CATEGORIES WILL BE PROCESSED?

The following categories of your personal data will be processed: passenger number, surname, name, date of birth, place of birth, father’s name, mother’s name, address (code, town, street, house number), type of work (school, work, not-working, unemployed, pensioner), name of the work place, address of the work place, type of document, number of document, date of document issue, PESEL, data of the fine, data related to the appeal, data related to hitherto amicable collection, data on the payments made, data of cases directed for litigation, data of cases directed for enforcement proceedings.

WHO CAN ACCESS YOUR DATA?

Your personal data will be made available to persons authorised by the personal data controller, entities authorised based on provisions of the law, entities fulfilling the role of economic information offices (e.g. KRD BIG S.A.), the post operator or courier in the field of paper correspondence, entities providing the collection services on behalf of the ZTM or providing IT services to the ZTM.

HOW LONG ARE WE GOING TO PROCESS YOUR DATA?

Your personal data will be stored for a period resulting from provisions of the law on archiving, i.e. 10 years, counting from the 1st of January of the next year after the case completion, that is from the 1st of January of the next year after payment of the debt or its cancellation. 

WHAT ARE YOUR RIGHTS IN RELATION TO PERSONAL DATA PROCESSING?

You have the right to the contents of your data and the right to request their rectification, erasure or restriction of processing as well as the right to object the processing. Moreover, you have the right to lodge a complaint with the President of the Personal Data Protection Office. 

WHERE DO WE HAVE YOUR DATA FROM?

Your personal data were acquired from:

a) Municipal Transport Union of the Upper-Silesian Industrial Region (KZK GOP) in Katowice,

b) Intermunicipal Passenger Transport Union (MZKP) in Tarnowskie Góry. 

WILL YOUR DATA BE USED FOR AUTOMATED DECISION-MAKING?

Your personal data will not be used for automated decision-making or profiling, referred to in GPRD Art. 22.
